Terms of Use

1. Acceptance of Terms

By accessing or using Fantikx (the "Platform"), you agree to be bound by these Terms of Use. If you do not agree to all terms, you must not use the Platform. These Terms constitute a legally binding agreement between you and NEXUSVIBE, SOCIEDAD LIMITADA, the operator of Fantikx.

2. Eligibility

You must be at least 18 years of age and the age of majority in your jurisdiction to use Fantikx. By creating an account, you represent and warrant that you meet these requirements. The Platform may employ age verification measures to ensure compliance with applicable laws, including the EU Digital Services Act (DSA).

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information during registration and to update such information as needed. You are solely responsible for all activities that occur under your account.

4. User Conduct

You agree not to use the Platform to:

• Upload, share, or distribute content that is illegal, non-consensual, or depicts minors in any context
• Harass, threaten, stalk, or intimidate other users
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Attempt to gain unauthorized access to other accounts, systems, or networks connected to the Platform

5. Content Ownership & License

You retain all rights to the content you upload to Fantikx. By uploading content, you grant NEXUSVIBE, SOCIEDAD LIMITADA a non-exclusive, worldwide, royalty-free license to host, display, distribute, and promote your content solely for the purpose of operating and marketing the Platform. This license terminates when you delete your content or account, except for content that has been shared or cached by other users.

6. Adult Content & Creator Responsibilities

Fantikx permits adult content created by consenting adults (18+). Creators who upload sexually explicit visual content are solely responsible for compliance with 18 U.S.C. § 2257 record-keeping requirements.

All creators must:

• Verify the age and identity of all persons depicted in their content
• Maintain records as required by applicable federal and international laws
• Ensure all content is produced with explicit, documented consent from all participants

Fantikx uses AI-powered content moderation to automatically detect and appropriately label adult content. Creators are required to accurately label their content when AI detection is insufficient.

7. Payments & Subscriptions

Payments are processed through Stripe. By purchasing a subscription or content, you agree to pay the stated price including applicable taxes. Subscription fees are charged monthly in advance. All prices are displayed in Fantiks (platform currency) or USD equivalent. Creators receive payouts according to the payout schedule detailed in their Creator Dashboard, subject to applicable fees.

8. Intellectual Property & DMCA

Fantikx respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed, please submit a DMCA notice as described in our DMCA Policy.

Users who repeatedly infringe intellectual property rights will have their accounts terminated in accordance with our Repeat Infringer Policy.

9. Audio & Music Responsibility

If your content includes audio, music, or soundtracks, you are solely responsible for ensuring you hold the necessary rights, licenses, or permissions to use such audio content.

Fantikx is not liable for content uploaded by users that may infringe third-party audio or music copyrights.

10. Termination

Fantikx may suspend or terminate your account at any time for violation of these Terms, applicable laws, or for any reason with or without notice. Upon termination, your right to use the Platform ceases immediately. Pending payouts may be withheld if there is evidence of fraud or Terms violations.

11. Limitation of Liability

Fantikx is provided "as is" without warranties of any kind. NEXUSVIBE, SOCIEDAD LIMITADA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid to Fantikx in the 12 months preceding the claim.

12. Changes to Terms

Fantikx reserves the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the Platform after such changes constitutes acceptance of the revised Terms.
